A Houghton County man faces two counts of first-degree criminal sexual conduct against a minor following his arraignment in 97th District Court on Sept. 4.
John Douglas Malloy, 46 years old, was charged as a fourth habitual offender in connection with the alleged crimes against a person under 13 years old. Judge Nicholas Daavetilla rescinded Malloy’s bond at the prosecutor’s request, and he remains housed in Houghton County Jail.
The charges stem from a criminal complaint filed with Michigan State Police in August.
Houghton County Prosecutor Dan Helmer expressed concern about the timeline for adjudicating the case, noting the backlog of pending trials in the county.
“I can only hope, for the public’s sake and the victim’s sake, that adjudication of this case doesn’t take years to get to trial,” Helmer said. “We have cases pending trial that are 2-3 years old. Our most recent criminal sexual conduct trial wasn’t scheduled until two and a half years after the incident, after being adjourned time and time again. Victims deserve better.”
Malloy is scheduled to appear in court twice during September. A preliminary examination is set for Sept. 21.
